This is more than the standard sentence for identity theft. The judge added time to the sentence stating that she didn’t believe that David had learned her lesson from the last conviction. David was still on supervised release when she stole Oreste’s identity.
Oreste Speciale’s credit is essentially ruined after Linda applied for eight different credit cards in his name. Running up bills on all of them buying gas, groceries, movies, toys, clothing, flowers and gift cards. David didn’t stop there she also bought a mini camcorder, 42” flat screen TV and a new laptop. He had to pay all of his business expenses upfront. Oreste had to move his family into the office because he could no long afford to pay rent. They have a newborn and have been forced to live in the attic space without heat.

Wow that’s nuts. I can’t believe that someone would do that and watch as the other person suffers. I think that penalty for identity theft was worst than it is. I think personal anguish should be taken into consideration when deciding how long the sentence should be.
